



Terms and Conditions

The term “Italian Seed Company” or “us” or “we” refers to the trading name of Alba Brands Limited the owner of the website and these terms and conditions govern the relation to the sale and supply of goods to the customer.
•The contract between us and the customer will exist only on our acceptance of the customers order and when payment has been received. We are entitled to withdraw from the contract in the case of obvious arithmetical inaccuracies appearing on our website.
•The prices of the goods displayed on our website are inclusive of all taxes. There will be an additional charge for delivery.
•Orders are subject to availability. If goods ordered are unavailable, the customer will be notified by Email that the item is out of stock.
•Price and availability information is subject to change without notice.
•Each order is for the personal, non-commercial use of our customer. Resale of any product without our express, written consent is strictly prohibited.
•We will dispatch the goods ordered to the delivery address supplied by the customer. All orders paid for by credit card will be dispatched the next working day if ordered by 8.00pm Monday to Friday. Orders paid for by cheque will be dispatched when the cheque is cleared which is normally 3 days after receipt. Despatch of goods constitutes fulfilment of contract.

If for any reason the customer is unhappy with their
purchase, they can return it to us for an exchange or refund, providing we receive
it within 28 days from the date of its original receipt by the customer. Returned
products must be received by us in good condition. Packets of seeds must be unopened.
A note explaining the reason for return should also be enclosed. This does not affect
your statutory rights. The customer bears the cost of returning goods for refund
or exchange, except in cases of faulty, damaged or wrongly supplied goods. We request
that the customer obtains proof of postage. If the goods delivered are not as ordered
or arrive damaged or defective, we will if the customer returns them within 28 days
on the customers discretion give a full refund, make good any shortage or replace
any damaged or defective goods.
•We cannot accept responsibility for seeds that have not germinated due to the fact that successful growing from seeds depends on many conditions beyond our control. However should your seeds fail we will be happy to replace them at any time within one year of purchase.
•Contracts between us and the customer will be governed by Scottish Law and all disputes will be submitted to the non-exclusive jurisdiction of the Scottish courts.
We may change these Terms and Conditions from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. These Terms and conditions are effective from 6 February 2009.
